Terms of use and Membership Agreement

Cadcut aims to produce personalized metal, plastic, glass and wood-derived products online, designed and drawn by you, easily, in high quality and quickly, and deliver them to you as soon as possible. (We produce all the parts you order within 3 working days and send them to your address by cargo.)

PLEASE READ THIS DOCUMENT CAREFULLY! CONTAINS IMPORTANT INFORMATION ABOUT YOUR RIGHTS, RESPONSIBILITIES, OBLIGATIONS, LIMITATIONS AND EXCLUSIONS THAT MAY APPLY TO YOU AS USER AND CUSTOMER.

This document includes MEMBERSHIP, TERMS OF USE and TERMS OF PURCHASE for the beneficiary of the order, hereinafter referred to as "you" or "customer / user" and the website www.cadcut.co, hereinafter referred to as "Cadcut". By accepting these Terms of Service, you are declaring to Cadcut that you are over the age of 18, or if you have not completed the age of 18, that you are performing the transactions on our website under the supervision of at least one of your parents. We reserve the right to change the eligibility criteria for our services and refuse any of our services at any time. You may not use our products for any illegal or unauthorized purpose or violate any statutory law, including but not limited to copyright laws, when using the service. You accept and declare that all material and moral responsibility that may arise from these violations belongs to you.

ORDERS, ONLINE PLATFORM AND PAYMENTS.

ACCEPTANCE OF TERMS

By placing an order with Cadcut, you confirm and accept that you have read and understood all the matters stated in this document. With this document, you declare to Cadcut that you are at least 18 years old, or that you are under the supervision of at least one of your parents, if you have not completed 18 years of age. We reserve the right to change the eligibility criteria for our services and refuse service to anyone at any time.

You may not use the products you ordered for any illegal or unauthorized purpose. You may not violate any laws in your jurisdiction (including but not limited to copyright laws) when using the service. Violation or breach of any of the Terms may result in immediate termination of your Services.

CHANGES IN DESCRIPTIONS AND PRICES

All information reflected in Cadcut can change and / or can be changed. Cadcut is not responsible for typos, images and any misinterpretation of them. Cadcut reserves the right to reject orders resulting from such errors.

ONLINE PRICE

Our website automatically generates prices through the documents you upload and options you add and select on our website. Prices automatically generated by the system may be subject to changes for external and/or internal reasons. Cadcut reserves the right to change or cancel the amount of the order due to changes in the price of raw materials, changes in cargo, transportation, tax and customs fees, fluctuations in the market or systematic miscalculation. It notifies the customer of this change via the system and / or by e-mail and / or telephone. In case of order cancellation, the payment made by the customer regarding this order is returned to the customer within 2 working days at the latest.

By accepting the terms and making the payment for your order, you confirm that you accept the price calculated and displayed on our website.

If Cadcut detects an error in the price, the customer will be notified about the new amount and a payment link will be sent via email. You will have 2 calendar days to accept this new price and make the payment. Otherwise, your order will be rejected.

DATA AND CHECKLIST

You accept that you are sure that all files, options and data added and / or submitted to Cadcut are correct by clicking the add to cart button. Cadcut is not responsible for order errors or misinterpretations caused by errors in files, options and data you upload and or added.

COMPLETION AND PRODUCTION OF THE ORDER

After placing the order, a confirmation message will be sent to the e-mail address you entered in the system, verifying that your order has been received with your order amount. This confirmation does not imply a firm order. After the inspection and approval of the received order, production takes place automatically in our facilities with a subsequent study for quality assurance with respect to your order specifications.

PAYMENTS

Payments to Cadcut could be made through PayTr platform by using VISA, MASTERCARD, or other banking payment systems.

Payment is made via PayTr with the method determined by you. The platform does the action instantly once you agree the transaction of the specified amount from your bank or credit card account. If there is insufficient balance in your account or any restrictions, PayTr detects an error in the transaction and the order is rejected. If you find any errors in the payment process or payment, contact us through our sales / contact department.

ORDER CONFIRMATION

Cadcut sends a confirmation e-mail to the e-mail address you specified for all orders. If you do not receive the confirmation email within 4 hours of completing your order, make sure the Cadcut mailing address is not blocked by the anti-spam filter or that the confirmation email has not ended up in the spam directory or deleted. If you haven't received or found the confirmation email after 4 hours, please contact us via Cadcut's sales/contact department. DO NOT RE-CREATE ORDER as this may result in duplication of orders and duplication of payments. Make the order again only if Cadcut confirms it via email. If you accidentally duplicate an order, notify Cadcut IMMEDIATELY. Otherwise, both orders will be processed.

ACCEPTANCE / REJECTION OF ORDERS

Cadcut reserves the right to accept / reject orders. In both scenarios below, you will be notified via e-mail within one business day at the latest.

ACCEPTANCE OF ORDER

Your order is deemed once you receive the e-mail notification that "Your order has been put into production". The same notification also confirms that the order will begin to be processed in our facilities in the received order.

DISCLAIMER OF ORDER

The reason for the refusal will be notified by e-mail. You will be informed of the measures to be taken to ensure that the order is in conformity with acceptance.

TRANSPORT

Cadcut has multiple shipping options depending on the status of the order (size, weight, urgency, region to ship the order, etc.). Cadcut decides these shipping options. It is not responsible for the delays that may occur in deliveries due to intermediaries beyond its control, including but not limited to the reasons stated below. (Customs and security controls, accidents, causes related to epidemics, weather oppositions, curfews, State of Emergency, force majeure, etc.)

CANCELLATION AND CHANGE OF ORDER

RETURN AND MONEY BACK

The service offered by Cadcut is a personalized, custom product, tailor-made for you and made to order. The production of your order is produced by the drawing, material type, thickness and number you want, which you upload to our site. Returning your orders is not an option; however, if there are discrepancies in your order, you can return it if a size, thickness or material other than your order was sent to you. Cadcut will refund the full amount of the order within 2 working days at the latest. If there is a discrepancy in your order, contact us through our sales/contact department.

REJECTING OR CHANGE OF ORDERS BY CADCUT

Cadcut reserves the right to cancel orders that are impossible to fulfill due to economic, technical and / or other reasons.

ORDER REJECTION

Cadcut reserves the right to cancel orders; In this case, the full amount paid will be refunded within 2 working days at the latest.

ADVICE TO CHANGE THE ORDER BY CADCUT

Cadcut reserves the right to suggest changes to orders. Recommendations will be sent to you by e-mail or telephone, stating the reason for the change request proposal. After your change proposal is accepted by you, if there is a situation that affects the order amount, you will be notified by e-mail or phone call. If there is an additional amount, you will be asked to pay via the payment link sent to you. Your order will be processed after the additional amount has been paid. If there is a decrease in the price due to the change, this amount will be refunded to you within 2 working days at the latest.

CANCELLATION AND CHANGE OF ORDERS AT YOUR REQUEST

The service offered by Cadcut is personalized and made to order. All services are made according to the drawing, materials, thickness and quantities you specify. It is possible to cancel or change an order at your request, if your order has not been put into production. If your order has been put into production, you cannot cancel your order. All orders are directed to the production department after technical control, and an e-mail is sent to you stating that your order has been put into production. Before this e-mail is sent to you, you can cancel your order by contacting us in writing via the Sales/Contact Department. In case of order cancellation, the full refund of the amount collected from you would be made within 2 working days at the latest. If there is a change in the order amount due to the change you want in your order, this amount will be notified to you via e-mail. If there is an additional amount, you will be asked to pay via the payment link sent to you. Your order will be processed after the additional amount has been paid. If there is a decrease in the price due to the change, this amount will be refunded to you within 2 working days at the latest.

PROTOTYPE TEST

We are very happy to receive high volume orders, but we want to make sure we're producing right before we start producing large batches. Cadcut reserves the right to pause an order where the technical difficulty or the number of units is higher than usual. Cadcut may offer you this via email or phone call for a fabrication/prototyping test before the order goes into full-production. This test may differ depending on the quantity and technical difficulty. Based on the test results of this prototype work, Cadcut has the right to continue production or cancel the order.

MATERIALS AND CUT FEATURES

TECHNICAL SPECIFICATIONS

This section contains various features about industrial processes such as Cut clearance, Cut tolerance, cut surface etc. There is no standard, detailed specification for laser cutting. The designs of the parts you want to be cut, the type and thickness of the materials have a great impact on the cut quality and surface quality. Different designs, materials give different results on the cut and part surface. If the size of the part is smaller than the material thickness, if the cut-outs on the design are smaller than the part thickness, if the cut surfaces are too close to each other; this may cause deterioration in cut surface/quality and might be related to your design details and the material you choose. Cadcut has no way of fixing and/or improving this. The material you choose for cutting is an industrial product. It may have light rust on its surface, production stains, dullness and crusts, scratches on its surface, etc. Various surface treatments are carried out by the manufacturer of all stainless and aluminum goods as they are turned into tools that you use in your daily life. It is not possible to achieve such shiny, smooth texture in the materials ordered by Cadcut. The product you have Cadcut made may not be the final product for you. All operations on the surface (surface burr removal, scratch removal, rust cleaning, polishing/polishing, painting, coating etc.) are the responsibility of the customer. If you want any features other than those specified by Cadcut in the materials you have chosen, you should specify them in the special notes section when ordering.

​MATERIAL PROPERTIES

All materials used by Cadcut are subject to tolerances and changes associated with the manufacture, handling and storage of the materials. You should be aware that typical differences may exist in all the materials’ color, thickness, weight, hardness, composition, texture, roughness, density, elastic modulus, conductivity, coefficient of thermal expansion, electrical resistance, melting point, resistance to oxidation, magnetic capacity, torsion and chemical reactivity.

MATERIAL QUALITY AND STDARDS

The quality series of materials used in Cadcut production processes are subject to material norms/standards. Cadcut uses standard materials (such as St37 for carbon steel, 304 for stainless steel, 1000 or 5000 series for aluminum) for the production of your personalized parts. If you have a material quality request other than these, you should notify us. This notification does not mean that the quality / quantity of that material will be provided and made by Cadcut.

SAFETY AND FUNDAMENTAL SAFETY INFORMATION

Cadcut has no control over the design, use and abuse of products manufactured for you. In order to create a functional and safe design, it is your responsibility to create appropriate conditions to protect the end user or other persons and property damage resulting from their use or special configuration. Remember that you must comply with all local and international laws, rules, regulations and safety regulations and all industry safety standards. Cadcut cannot be held responsible for all the negativities (material and moral) that may occur due to your non-compliance with the law, regulation, statute, rule, and standards.

Cadcut will not be liable for any loss or damage suffered by you or any other party as a result of the design, production, use, misuse, assembly or application of special parts produced for you.

HEALTH / MOBILE APPLICATIONS / OTHER CRITICAL SECURITY SECTORS

Special parts produced by Cadcut for you are not made for the use of land and air transportation vehicles, weapon parts and systems, medical devices-life support equipment, mountaineering and extreme sports, airplanes, helicopters, rockets, etc. It is not intended for aircraft construction and parts. It should not be used in any application where problems such as malfunction, breakage, breakage, warping of the said part manufactured for you by Cadcut may cause personal injury, disability and/or death to oneself or anyone else. If you use custom parts manufactured by Cadcut for you for such purposes, you agree that you do so at your own discretion and risk, and Cadcut is not responsible for any claims or damages resulting from such use. Cadcut is exempt from any claim and liability arising from the stated situations. Cadcut cannot be held responsible for any loss or damage suffered by you or any other party arising from the stated situations.

HELP AND ADVICE

Cadcut can offer suggestions about the files and options you have uploaded/chosen. It is your decision whether to apply these suggested by Cadcut or not. You agree that any problems that may arise due to this advice and recommendation are at your own risk.

INTELLECTUAL PROPERTY

You declare that the designs and other information of the special parts you want to be produced by Cadcut are yours, original and your property, and designed by you or belong to third parties that you want them to be produced with their consent. You warrant that you do not infringe any rights (including patents, copyrights, or trade secrets) of any third parties. In addition, you warrant and represent that the designs do not violate any national or international laws, intellectual or industrial laws, etc. You agree that you are responsible for any claim, liability, liability and penalties that may arise from the manufacture, use, assembly and/or execution of any order. You acknowledge and agree that Cadcut is exempt from all liabilities, material and moral penalties and fees that may arise due to these.

PERSONAL INFORMATION AND DESIGNS

We reserve the privacy rights of all information sent to the www.cadcut.co website. However, you understand and agree that Cadcut may disclose to its employees and third parties the information necessary to provide services related to the production, resolution, shipping and rectification of your order. We can take the post-production photo images of the special pieces produced for you before they are sent to you, and publish them on various social media platforms (Facebook, Instagram, Twitter, Youtube Linkedin etc.) and in the case studies section of our site. You hereby consent to this publication. Cadcut does not need to obtain written and verbal permission from you for these shares. If you do not want the photo images of the products you have made to be shared anywhere, you should notify us in writing in the special notes section of the section where you ordered.

ABOUT TERMS OF USE AND TERMS OF PURCHASE

Applicable Law and Authority

All disputes arising from TERMS OF USE AND TERMS OF PURCHASE are subject to Turkish Law and Sakarya Courts and Enforcement Offices are authorized. Cadcut is not liable for late performance or non-performance of these TERMS OF USE in all situations that are legally considered force majeure. This and similar cases will not be deemed as default for Cadcut's delay or non-performance and Cadcut will not be liable for any compensation.

LANGUAGE AND VALIDITY OF TERMS OF USE AND TERMS OF PURCHASE

These TERMS OF USE AND TERMS OF PURCHASE The Turkish version is the legally binding version in case of any inconsistency between the Turkish version and the translation into another language.

CHANGES TO TERMS OF USE AND TERMS OF PURCHASE

Cadcut reserves the right to revise or change the terms. When you use this website or order products from us, you are subject to the applicable policies and these terms, unless they are changed; Terms of use and terms of purchase may also vary according to the law or the decisions taken by the authorized body of the government. Cadcut reserves the right to modify this binding document (in the Terms of Use and Conditions of Purchase) according to a particular situation without notice. The Terms of Use and Conditions of Purchase to be applied to an order are valid at the time it is processed.

This agreement, TERMS OF USE AND TERMS OF PURCHASE have been drawn up on the specified date, leaving the earlier versions invalid and unenforceable. 23/03/2020
